TERMS AND CONDITIONS OF THE epraktyk.pl ONLINE STORE

1. The owner of the Online Store (hereinafter referred to as the "Store") and the seller of the articles offered in it is ePractice Bartosz Zieliński, NIP number 8191588059, hereinafter referred to as the Seller or the Store.

§ 1
General provisions

1. These Regulations define the conditions for concluding and performing all sales contracts concluded with the Seller via the Online Store. Pursuant to Art. 384 of the Civil Code, they are part of the contract concluded with the Seller.
2. The Seller reserves the right to change the regulations. The change of the provisions of these Regulations does not apply to orders accepted for execution. Any changes to the regulations come into force on the day of their publication on the website epraktyk.pl. Each User will be informed about the content of the changes to the Regulations by the Store on the main page of the Website, publishing a message about the change in the Regulations, containing a list of changes to the Regulations and maintaining this information on the main page of the Website for a period of at least 14 consecutive calendar days, and Users who have a User Account will be additionally notified by the Service Provider by sending to the e-mail address indicated by them in the registration form information containing a list of amendments to the Regulations. Information about the change in the Regulations will take place no later than 14 calendar days before the introduction of the amended Regulations. If the User who has a User Account does not accept the new content of the Regulations, he is obliged to notify the Store about this fact within 14 days from the date of notification of the change in the Regulations.
3. These Regulations also apply to Customers who have placed Orders by phone.
4. The Regulations were created on the basis of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws, No. 144, item 1204, as amended). In matters not covered by these Regulations, the provisions of the above-mentioned shall apply. the Act and the Act of April 23, 1964, Civil Code, and the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended).

§ 2
Orders

1. You can purchase a product by registering on the website of the online store by providing the data necessary to complete the order. The purchase can also be made without registration.
2. The selection of the ordered Goods by the Customer is made by adding them to the basket.
3. After the Customer using the Online Store has provided all the necessary data (in the case of not having an account, contact and address details, in the case of having an account, the data will be downloaded automatically), a summary of the placed Order will be displayed.
4. The Buyer is obliged to provide correct and complete personal data, otherwise the order may not be completed due to the inability to deliver the goods.
5. Orders can be sent via the Store's website or made by phone by calling 530 737 841.
6. Incorrectly completed forms do not constitute an order and will not be implemented. In particular, forms that do not contain a contact telephone number or e-mail address of the Customer, enabling the Store to confirm the order received, will be considered as incorrectly completed forms. The store does not inform the customer about the rejection of the order form, if the customer has not provided contact details by phone or via e-mail.
7. In the event of any doubts regarding the content of the order form submitted by the Customer and received by the Store, the Store reserves the right to suspend the execution of the order until these doubts are resolved. The Store will immediately notify the Customer about the suspension of the order.
8. Placing an order is connected with the obligation to pay for the selected goods, and the entrepreneur undertakes to deliver the goods without defects.


§ 3
Order confirmation

1. For the purpose of verification, each order received by the Store, deemed correct in accordance with the provisions of these Regulations, will be confirmed by the Store on the day of its receipt or within the next three business days.
2. The Store confirms that the order has been placed by e-mail to the e-mail address provided by the Customer in the order form. Along with the order confirmation, the Customer receives the regulations for the provision of services with attachments to the e-mail address provided.
3. The Store confirms the placed order in the manner indicated in sec. 2 and the customer's acceptance of the regulations with attachments is tantamount to concluding a sales contract. The sales contract is concluded in Polish, with the content in accordance with the order (in which the subject, price and buyer's data will be indicated) and the Regulations and attachments (in which the rights of the parties and the seller's data are specified).
4. An order which, for any reason, cannot be confirmed as specified in sec. 1 and 2 on the date and mode, is automatically canceled without informing the customer.


§ 4
Articles available in the Store

1. An order may only refer to items listed in the current catalog available on the Store's website. When placing an order, the customer precisely specifies the type, name and catalog price of the article and provides its catalog number - by adding the goods to the basket (thus accepting the above-mentioned data). The customer is obliged to indicate the number of items of the purchased goods, otherwise it will be deemed to be ordering 1 item by default.
2. Information on the articles available in the Store does not constitute an offer, but only an invitation to submit offers within the meaning of Art. 71 of the Act of 23 April 1964 Civil Code. The offer is, however, the correct order of the customer addressed to the store.
3. Prices of products available in the Store are expressed in Polish zlotys and include VAT. The store reserves the right to change the prices specified in the catalog and the right to withdraw some products from sale without giving reasons. In the event of a price change after placing the order, the Store will inform the Customer about the situation at the latest at the time of order confirmation. If the Customer does not accept the new price, the order is considered canceled.


§ 5
Payment methods

1. Payment for the assortment purchased in the Store, according to the Customer's choice made on the order form, is as follows:

2. If the Customer makes a payment in the manner referred to in sec. 1 point a) the condition for the Store to proceed with the order is receipt of a bank confirmation of payment, and the time of order fulfillment referred to in § 6 sec. 3 is counted from the date of receipt of such confirmation by the Store.

§ 6
Delivery

1. The ordered articles will be delivered to the customer according to his choice via a courier company. The data on the parcel will include the name and surname and address indicated by the customer in the order form. Along with the shipment, the Customer will receive a written confirmation of the essential elements of the concluded sales contract, along with the regulations and attachments.
2. The customer has the right to choose - within the limits specified in the content of the order form - the method and company making the delivery. By making a choice, he agrees to the prices related to the chosen method and entity making the delivery, which in this case may be different.
3. The order fulfillment time is up to 14 days from the date of the final confirmation of the order by the Customer and is the time in which the Store staff will prepare the ordered articles and deliver the shipment to the courier for delivery to the Customer. The store is not responsible for delay or non-delivery of the shipment resulting from providing incorrect customer address details or other reasons attributable to the customer.
4. The Store is not responsible for technical problems or technical limitations in the computer equipment, terminal equipment, ICT system and telecommunications infrastructure used by the Customer, which prevent the Customer from using the Store properly.
5. The order fulfillment period usually does not exceed 7 working days. The exception may be orders for items currently unavailable or custom-made items. In this case, the completion date may be extended (in individual cases even up to several dozen days), the Buyer will be immediately informed about such a fact.
6. The Customer is informed about the date of order fulfillment during the order verification (by phone or via e-mail), which takes place in
within 2 working days from placing the order.
7. Shipping costs are borne by the customer and depend, among others, on on weight and size
shipment, its value, etc.


§ 7
Order return - the right to withdraw from the contract

1. The customer has the right to withdraw from a distance sales contract without giving any reason, within 14 days from the date of receipt of the goods.
2. In the event of exercising the right to withdraw from the concluded contract, a written statement of withdrawal from the contract must be submitted and the signed statement sent to the postal address of the Store: ePraktyk Bartosz Zieliński, ul. Talasiewicza 16, 38-100 Strzyżów, before the expiry of the above-mentioned period.
3. The declaration of withdrawal from the contract, the bank account number to which the money should be returned to the customer and the returned goods should be sent to the following address: ePraktyk Bartosz Zieliński, ul. Talasiewicza 16, 38-100 Strzyżów.
4. The money will be returned to the customer to the bank account indicated by him, the number of which should be attached to the statement on withdrawal from the contract.
5. The returned goods should be returned immediately, but not later than within 14 days from the date of sending the seller the declaration of withdrawal from the contract.
6. The customer is asked to return the goods in the original packaging with the complete content and a copy of the proof of purchase.
7. The returned goods must be in an unchanged condition, ie must have original labels and must not bear any traces of use beyond the usual scope of inspection.
8. Pursuant to the Act of 30 May 2014 on consumer rights, products related to audio and visual recordings and data stored on IT data carriers (such as CDs with music, software, e.t.c.).


§ 8
Liability for defects in the goods

1. The basis for the complaint of mechanically damaged goods is the damage report drawn up in the presence of a Post Office employee or courier.
2. Selected articles available in the Store have a guarantee granted by the entity granting the guarantee (the Guarantor) on the terms specified by it in the guarantee document attached to the article.
3. In the event of a complaint (under the warranty), please contact the service center indicated in the warranty document directly. In such a case, the rules related to the complaint procedure will be specified in the guarantee document.
4. The above provisions do not exclude the possibility of pursuing claims under the warranty against the seller on general terms.


§ 9
Withdrawal from the contract

1. The customer who is not an entrepreneur has the right to withdraw from the contract concluded via the Store within fourteen days from the date of delivery of the item. The condition for the exercise of the right to withdraw from the contract is the submission by the Customer of an appropriate statement in writing.
2. Goods delivered to the customer via a courier company should be sent to the following address: ePraktyk Bartosz Zieliński, ul. Talasiewicza 16, 38-100 Strzyżów.


§ 10
Complaint

1. Complaints are considered in accordance with the Act of 30 May 2014 on consumer rights
2. The Customer has the right to demand from the Store to bring the purchased assortment to a condition consistent with the contract by free repair, reduction of the price of the purchased goods, replacement with a new one or withdrawal from the contract if the defect is significant.
3. The seller may refuse to agree to the way of exercising the warranty rights proposed by the buyer, if such a choice is impossible to meet by the seller or would require excessive costs compared to the choice proposed by the seller.
4. Complaints arising from the violation of the Customer's rights guaranteed by law or under these Regulations should be sent to the following address: ePraktyk Bartosz Zieliński, ul. Talasiewicza 16, 38-100 Strzyżów.
5. If the complaint is accepted, the damaged goods will be repaired or replaced with another, full-value goods in accordance with the Customer's request, and if it is no longer possible (for example due to the exhaustion of goods stocks), the Store will refund the Customer the equivalent of the price of the goods or, with the consent of the Customer, will offer him other goods available in the Store to choose from.
6.Differences in the appearance of the goods delivered with the ordered, viewed on the Store's website, which may result from other settings (parameters) of the Customer's monitor, and other peripheral devices of the Customer's computer used to familiarize themselves with the Store's offer, in particular the difference in colors and shades, do not constitute grounds for returning the goods.
7. Complaints are not subject to:

• damage resulting from improper use and maintenance of the goods,
• damage resulting from the wear and tear of the goods,
• goods used contrary to their intended use,
• convenience of goods.


§ 11
Return

1. If the Customer receives an order in a damaged package, this fact must first be reported to the Store's employee via e-mail and then the goods should be returned to the Store.
2. The reimbursement payment will be sent to the bank account specified in the return form or sent by postal order.

§ 12
Disputes

1. Settlement of any disputes arising between the Store and the Customer, who is a Consumer, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
2. Settlement of any disputes arising between the Store and the Customer who is not a Consumer shall be submitted to the court having jurisdiction over the seat of the Store.


§ 13
Final Provisions

1. The customer, by selecting a special check-box, agrees to the use and processing of his personal data for the purpose of order fulfillment, as well as the transfer of his e-mail address to external companies and to the processing of my personal data by the Seller and external companies in order to complete the submission process evaluation questionnaire. orders, order fulfillment questionnaires and product evaluation questionnaires (in accordance with the provisions of the Personal Data Protection Act of August 29, 1997).
2. For the avoidance of doubt, it is stated that none of the provisions of these Regulations limits the consumer's rights under the provisions of law in force in the territory of the Republic of Poland. In the event that a provision of this nature exists, the provisions of the law in force in the territory of the Republic of Poland shall apply, in particular the Civil Code and the Act of 30 May 2014 on consumer rights.
3. The customer who makes a purchase in the store, after selecting a special check-box, agrees to the processing of personal data by the epraktyk.pl store in order to complete a questionnaire with an opinion about the transaction in the epraktyk.pl store
4. Recognition of individual provisions of these Regulations in the manner prescribed by law as invalid or ineffective, does not affect the validity or effectiveness of the remaining provisions of the Regulations. In place of the invalid provision, the law most similar to the purpose of the invalid provision and to the provisions of these Regulations will be applied.
